Senate Vacancy Initiative Denied Certification

Lieutenant Governor Loren Leman announced Tuesday that he will not certify an application for an initiative entitled: "An Act relating to filling a vacancy in the Office of United States Senator."

The Lieutenant Governor made the decision to deny certification based on a recommendation by the Department of Law, which determined that the Seventeenth Amendment of the United States Constitution gives state legislatures sole authority to decide how to fill U.S. Senate vacancies. Therefore, the process of filling a vacancy in the United States Senate cannot be repealed through the initiative.
