Alaska: State Appeals Judgment in Carlson on Non-Resident Fishing Fees - In a long-running class-action case concerning commercial fishing fees the state charged non-residents, a Superior Court judge has awarded the plaintiffs a judgment against the State of Alaska of nearly $75 million, with an additional $7.5 million assessed against the state for plaintiffs' attorney's fees.

The so-called Carlson case, which began in 1984 and has spanned over a quarter of a century, has been reviewed four times by the Alaska Supreme Court. In it, roughly 12,000 plaintiffs challenged state laws charging non-resident commercial fishermen three times more than residents. They also sought refunds of any overpayment of fees. The state prevailed against roughly 2/3rds of the plaintiffs.

In the latest superior court ruling issued Monday, Judge Peter Michalski determined the remaining fishermen were entitled to refunds totaling $12 million. The remainder of the $75 million judgment is the result of a decision in 2003 by the Alaska Supreme Court to apply a statute with an unusually high interest rate to the refund amount, with interest accruing from the beginning of the case.

"For years, the Department of Law has worked closely with legislators on this matter, and we are providing them details on this latest decision," said Attorney General Dan Sullivan. "We have also filed an appeal to the Alaska Supreme Court challenging the interest rate applied in the judgment and the attorney's fees award against the state."

Judge Michalski's ruling establishes the particulars of the judgment against the state, based on previous decisions by the Alaska Supreme Court. The ruling sets out the final judgment as follows: - More...

Alaska: OFFICIALS CONDUCT TEST OF THE ALASKA TSUNAMI WARNING SYSTEM - A test of the Alaska Tsunami Warning System was conducted this morning by the National Oceanic and Atmospheric Administration's (NOAA) National Weather Service and the Alaska Division of Homeland Security and Emergency Management in cooperation with local emergency management offices and the Alaska Broadcasters Association. At approximately 9:45 a.m. Alaska Daylight Time, a live tsunami test code was distributed by the Alaska Emergency Alert System (EAS).

"Testing of the Tsunami Warning System ensures that the system will work as designed during an actual emergency," said Brig. General Thomas H. Katkus, commissioner of the Department of Military and Veterans Affairs. "As communication systems across the state are constantly changing and being improved, each test helps up keep up with those changes."

Through a proclamation signed by Governor Sean Parnell, March 21 - 27, 2010 has been declared Tsunami Awareness Week. The week coincides with the anniversary of the Great Alaskan Earthquake, a devastating 9.2 magnitude earthquake that triggered deadly tsunamis in Alaska 45 years ago on Good Friday. Alaska: Murkowski Presses Defense Department on Case Last Year Involving Illegal Immigrants Working at Elmendorf - U.S. Sen. Lisa Murkowski, R-Alaska, on Tuesday pressed a senior Defense Department official for details on what the service has done to close a loophole that allowed illegal immigrants to work on Elmendorf Air Force Base last year before the security breach was discovered.

Murkowski questioned Dr. Dorothy Robyn, Deputy Under Secretary of Defense for Installations and Environment, at a hearing of the Senate Appropriations Military Construction Subcommittee.

Last October, acting on a tip from the Ironworkers Local 751 in Anchorage, agents from U.S. Immigrations and Customs Enforcement (ICE) discovered that four of 30 employees of an Air Force construction contractor building hangars at Elmendorf were in the country illegally and that one of the four had a criminal history in California.

"I think we all recognize that our Air Force bases are supposed to be secure areas and yet this was a pretty specific example of not only people not eligible to work here in this country and get into the gate and do the work, but of an employee with a criminal record," Murkowski said.

Murkowski asked whether the contractor had been disciplined and what the Obama Administration was doing to ensure that scarce constructions jobs are going to people legally entitled to work in the United States.

Robyn said she couldn't say for sure whether the contractor was disciplined. "It's hard to believe that they were not because my understanding is this was a contractor from California that went up to Alaska and took workers with him, so it would seem that they were liable" she said. - More...

Wrangell: Forest Service, partners gear up for annual Stikine River Birding Fest - Visitors from all over Southeast Alaska will migrate here this spring for the Annual Stikine River Birding Festival, taking place April 27 through May 2, 2010.

Wrangell is the gateway community for the Stikine River Delta, where the arrival of thousands of bald eagles creates the largest springtime concentration in North America. The festival is also the perfect opportunity for adventurous birdwatchers to observe millions of shorebirds, which migrate to the delta each spring. This delta lies within the Wrangell Ranger District of the Tongass National Forest.

This year's festival features guest artist and illustrator Evon Zerbetz, who will host student classes, adult workshops, a public lecture, book signing and art exhibit. Weekend events include the Ducks Unlimited Banquet, guided bird walk with local author Bonnie Demerjian, Juneau Raptor Center presentation, Muskeg Meadows Golf Tournament, and local arts and crafts fair with silent auction. - More...

Alaska: Alaska's Delegation Comments on Passage of Health Care Reform Bill; "Fully paid for" says Begich; Murkowski says "We can not afford it"; "The people's House turned its back on the people" says Young - Each of Alaska's delegates released prepared statements voicing their positions on the House of Representatives' passage of the health care reform legislation Sunday night.

U.S. Sen. Mark Begich (D-AK) said in his prepared statement released Tuesday, "I was proud on Christmas Eve to cast my vote in favor of this historic legislation, which will save lives, save money and save Medicare. I am on the side of Alaska families, not on the side of the insurance industry. I am on the side of seniors who will see lower prescription drug prices, not on the side of the big drug companies. I am proud to be on the side of Alaska's small business, not on the side of business as usual."

Begich said, "The House on Sunday night passed the comprehensive Senate health insurance reform bill I voted for in December as part of a supermajority of 60 senators. House members also sent the Senate separate legislation strengthening health insurance reform. This legislation will allow an up or down vote to remove the special deals Alaskans have expressed concerns about. We will take up the bill today, and expect to pass it by the end of the week."

U.S. Senator Lisa Murkowski (R-Alaska) issued a prepared statement Sunday night after the House of Representatives passed the health care legislation:

Murkowski said, "Proponents of the partisan health care bill say that the public will like the bill once it is passed. Will they like the fact that Americans will have to pay four years of taxes before they get the benefits? That's like making mortgage payments for four years before you can move into your new home. Will they like that the legislation cuts Medicare by more than $500 billion at a time when the program is slated to go broke in seven years? Will they like a half trillion dollars in new taxes to help pay for a massive government expansion of health care? At a time when the nation's debt has reached historically high levels, and the economy remains in a deep recession with unemployment hovering near 10 percent, this is the wrong bill at the wrong time. At more than $2.6 trillion, the cost of the legislation in its first 10 years of full implementation, we cannot afford it."

In a prepared statement Sunday night Congressman Don Young (R-AK) said, "Today is a very bad day. Today, the people's House turned its back on the people."

Young said, "Today [Sunday], a bill was rammed down the throats of good Americans who trust us to preserve their freedoms and today, those freedoms were stifled. Thousands gathered on the National Mall this weekend to let their voices be heard because they are scared. They are scared that their liberties are being stomped on and they are scared of the government intrusion in their lives and they are right."

Young said, "This Administration force-fed America a bill that will increase premiums while growing inefficient government bureaucracy by establishing nearly 160 new boards, commissions, and programs. This bill doesn't include real health care reform, it's reform in name only. What we passed is composed of ego and partisanship, and does nothing to help Alaskans and nothing to help our country."

Begich said, "The process has been very transparent. The bills were debated in hearings and televised sessions of Congress for months. The Senate spent 25 consecutive days in session on health reform - the second longest session in history - for a total of 160 hours on the floor. In addition, despite complaints about lack of involvement from the other side of the aisle, the truth is the final Senate bill includes 147 minority party amendments. The President also hosted a bipartisan health care summit, which I was pleased to see televised," stated Begich in his prepared statement."

First of all, I oppose SB 129 because I don't think the state should pick and choose the way the local community should conduct their business. This is our 2010 Kayhi Academic Decathlon State team and they did something magical on the last weekend of February. For those of you who don't know what it is: Academic Decathlon (AcDc...small "c" no copyright infringement here!) is a school sponsored activity that has kids studying Math, Music, Art, Economics, Literature, Science (Chemistry this year) and the Superquiz (this year it was the French Revolution) so they can take tests on those subjects. For fun. They also write an essay, give two speeches and attend an interview as part of the competition. This year they placed in all but one event, took third in the Oral Superquiz and were the second place OVERALL in the STATE! It is going to make such a difference in the playing ability and experience for our soccer and football players. Our track and field participants now have beautiful track and field event place. This is a dream come true for many. Now it is up to all the folks of Ketchikan to work together and take care of this beautiful facility. This means NO DOGS! No exceptions. I love dogs as much as the average Ketchikan citizen (I have 3), but dogs will destroy the track and field. Their nails tear up the track and rubberized field surface. Urine will clog the drainage system and disintegrate the rubber pellets and I will avoid describing what dog poop does to fields. I think both would benefit the community economics. Hotels and restaurants would see a boost from outside teams coming for competitions. All stores would see more spending. letterRe: Wake Up Parents By Bethany Phippen - I just finished reading Lori Headley's letter responding to Spring McCurry's statement. I don't know if you have children, but I don't know of one single Pediatrician who is going to have ANY child with a fever outside in just a diaper. Yes, my kids are 4 and 7, and I have to argue with them occasionally about wearing their coats outside to go play. I can understand where high school students don't wear coats, but having an infant outside in a diaper there is no excuse for. If a child has a dangerously high fever you alternate tylenol and ibuprophen every 4 hours, you run them a cool bath, not so cold that they go into shock. If you know of ANY doctor that is recommending a child go outside in 40 even 50 degree weather to get them over a fever, they need to be turned in for malpractice. letterIndoor Sports Facility By Jeff Carson - You may have noticed a petition going around town that asks for your support in urging the Borough to help a local group remodel the veneer building into an indoor turf field facility. This letter is to answer the questions that have come about because of this petition. First of all, the plan is to install a 250' by 100' sport turf field that would run from the south wall of the building 250 feet to the north. Currently in Ketchikan there are 2,241 kids who participate in Little League baseball, youth softball, youth soccer, wrestling, dribblers league, gymnastics, Kayhi baseball, softball & soccer & youth football. All of these kids would benefit from this facility, especially in the Winter months.
