Supreme Court Decision Clarifies Submerged Land Title Issues
in Southeast Alaska - The United States Supreme Court issued
a decision Monday that clarified state and federal title rights
to submerged lands in Glacier Bay and other areas within Southeast
Alaska.
The State of Alaska filed the
lawsuit in November 1999 to quiet title to the lands underlying
marine waters in Southeast Alaska. At issue were claims to title
to the lands underlying all marine waters of the Alexander Archipelago,
including those within the boundaries of the Tongass National
Forest, Glacier Bay National Park and certain "doughnut
hole" areas that are more than three miles from any land.

Southeast Alaska: New
Agreement Promotes Collaborative Approach to Conservation in
the Tongass National Forest - The Nature Conservancy and
the USDA Forest Service announced today that they have signed
a five-year Memorandum of Understanding (MOU) to work together
to achieve a balance of working forests, habitat reserves, and
sustainable communities on the Tongass National Forest.
Forrest Cole, Tongass National
Forest Supervisor, and David Banks, state director for the Conservancy
in Alaska, signed the agreement last month. - More...

Alaska: Murkowski
Signs Health Care Tort Reform Bill - Alaska Governor Frank
H. Murkowski signed into law a bill to limit non-economic damage
awards made against health care providers. The bill is intended
to curb skyrocketing medical malpractice insurance rates that
place Alaska at a competitive disadvantage with other states
and help attract and retain a qualified pool of physicians in
the state.
"Alaska has a shortage
of doctors and a lack of choices for those doctors who need to
maintain responsible malpractice insurance coverage," Murkowski
said. "This bill begins the process of giving Alaskans an

Supreme Court Decision Warrants State Review of Alaska's Medical
Marijuana Registration Law - Monday the United States Supreme
Court issued an opinion finding that California's medical marijuana
laws are not a bar to enforcement of federal anti-drug laws.
Monday's decision may have substantial implications for a similar
law in Alaska.
In the decision, Gonzales
v. McClary Raich, (Raich), the high court noted that
the federal Controlled Substances Act (CSA) (which is Title II
of the Comprehensive Drug Abuse Prevention and Control Act of
1970) designates marijuana as "contraband for any purpose."
In the process, the court also recognized that Congress rejected
the idea that marijuana has any acceptable medicinal use. - More...

Alaska: New
Alaska Psychiatric Institute Dedicated - Alaska Governor
Frank H. Murkowski and other state, local officials and mental
health advocates participated Friday in a dedication ceremony
for the new Alaska Psychiatric Institute (API), located next
to the old API.
"The new Alaska Psychiatric
Institute will serve our citizens who suffer from psychiatric
disabilities with the best programs we can offer," said
Governor Murkowski. "This facility's form and function embody
the best thinking of many Alaskans who worked more than 15 years
to build the most sophisticated psychiatric treatment center
